ITG TERMS & CONDITIONS

These Terms & Conditions apply to the use of the ITG website, the purchase of ITG clothing and merchandise, and the purchase or participation in ITG Hoops basketball training, programs and packages.

By purchasing a product, booking a training session or participating in an ITG Hoops program, you agree to these Terms & Conditions.
1. ITG HOOPS — CODE OF CONDUCT
Participants are expected to behave respectfully towards all ITG Hoops coaches, staff, athletes and other participants.
ITG Hoops reserves the right to remove a participant from a session, program or facility for inappropriate, abusive, threatening or unsafe behaviour.
Where a participant is removed due to serious misconduct, ITG Hoops may refuse a refund to the extent permitted by law.
2. PUNCTUALITY
Players are expected to arrive at the workout location at least 10 minutes before the scheduled commencement time.
Late arrival may reduce the amount of training time available. Sessions will generally not be extended to compensate for late arrival.
3. TRAINING BOOKINGS & PAYMENTS
Training sessions and packages must be paid for in full prior to participation unless otherwise agreed with ITG Hoops.
By purchasing a training package, you acknowledge that sessions are subject to availability and must be scheduled in accordance with ITG Hoops' booking procedures.
ITG Hoops does not guarantee that unused sessions will be refundable.
Training packages may have an expiry period where specified at the time of purchase.
4. CANCELLATIONS, MISSED SESSIONS & REFUNDS
A minimum of 12 hours' notice is required to cancel or reschedule a training session.
Sessions missed without the required notice may be forfeited and will generally not be refundable.
Late arrivals do not guarantee extended session time.
Once a training package has commenced, refunds will generally not be provided for unused sessions, subject to any rights or remedies that cannot legally be excluded.
If ITG Hoops needs to cancel or reschedule a session due to facility issues, weather, illness, safety concerns or other unforeseen circumstances, ITG Hoops will make reasonable efforts to reschedule the session or provide an appropriate alternative.
Nothing in these Terms & Conditions excludes any rights a customer may have under applicable consumer law.
5. MEDIA RELEASE
Where a participant or parent/guardian has provided consent, ITG Hoops may photograph, film or record workouts, events and other activities for promotional, marketing and social media purposes.
By providing media consent, you acknowledge that:
Photos, videos and audio recordings may be used for ITG Hoops promotional, marketing and social media purposes.
You will not receive compensation, payment or royalties for approved use of this content.
ITG Hoops may use approved content on its website, social media platforms, advertising and other promotional materials.
Media consent may be withdrawn in writing for future use.
Withdrawal of consent does not require ITG Hoops to remove content that has already been published or distributed before the withdrawal request, where legally permitted.
ITG Hoops may use a participant's name, image, likeness and voice where the relevant consent has been provided.
For participants under 18, media consent must be provided by a parent or legal guardian.
6. HEALTH, SAFETY & PARTICIPATION
Participation in basketball training is voluntary.
Participants have the right to stop or refuse an activity at any time.
Basketball and athletic training involve inherent risks, including but not limited to strains, sprains, muscle injuries, fractures, falls, collisions, cardiovascular events and other injuries or illness.
Participants and parents/guardians are responsible for informing ITG Hoops of relevant injuries, medical conditions, allergies or other circumstances that may affect safe participation.
Participants should not attend training when unwell or experiencing symptoms of an infectious illness.
ITG Hoops may refuse participation where a participant appears unfit or unable to safely participate.
7. INJURY & EMERGENCY MEDICAL CONSENT
In the event of an injury during an ITG Hoops session, staff may provide basic first aid within their training and determine whether further medical attention may be required.
For participants under 18, the parent or legal guardian authorises ITG Hoops staff to seek appropriate emergency medical assistance if reasonably necessary and the parent or guardian cannot be reached.
ITG Hoops will make reasonable efforts to contact the nominated emergency contact in an emergency.
Participants and parents/guardians remain responsible for providing accurate emergency contact information.
8. LIABILITY
Participants acknowledge that basketball and athletic training involve inherent risks.
To the maximum extent permitted by law, ITG Hoops is not responsible for injury, loss or damage arising from risks inherent in participation or from circumstances outside ITG Hoops' reasonable control.
ITG Hoops does not accept responsibility for medical expenses incurred by participants except where ITG Hoops is legally responsible for those expenses.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under applicable law, including rights under the Australian Consumer Law.
9. PERSONAL BELONGINGS
Participants are responsible for their own personal belongings brought to training sessions or facilities.
To the maximum extent permitted by law, ITG Hoops is not responsible for personal belongings that are lost, stolen or damaged.
10. ITG CLOTHING & MERCHANDISE
ITG sells clothing and merchandise through its website.
Products may be made to order and fulfilled through third-party fulfilment provider Tapstitch.
Product images are provided for illustrative purposes. Actual colours may vary slightly depending on your device, screen settings, lighting and manufacturing processes.
Product measurements and specifications may have minor variations.
11. CLOTHING ORDERS & PAYMENTS
All clothing orders must be paid for through the payment methods available at checkout.
Prices are displayed in Australian dollars (AUD) unless otherwise stated.
ITG uses Squarespace Payments to process payments.
ITG reserves the right to correct obvious pricing or product information errors.
If ITG is unable to fulfil an order, we will contact the customer and provide an appropriate remedy, including a refund where applicable.
12. SHIPPING
ITG currently ships to:

Canada
Shipping charges are calculated at checkout.
ITG offers free shipping on orders over $150 AUD, subject to the applicable shipping conditions displayed at checkout.
Because products may be made to order, production and delivery times can vary.
Estimated delivery times are provided as a guide and are not guaranteed delivery dates.
Customers are responsible for providing accurate shipping information.
International customers may be responsible for customs duties, taxes, import charges or other fees imposed by their destination country.
13. CLOTHING RETURNS & EXCHANGES
ITG accepts eligible change-of-mind returns requested within 7 days of the customer receiving their order.
Returned products must be:
Unworn
Unwashed
In original condition
Free from damage or alterations
Returned with original tags and packaging where applicable
Customers are responsible for return shipping costs for change-of-mind returns.
Original shipping costs are not refundable for change-of-mind returns.
Size exchanges may be requested within 7 days of receiving an order and are subject to availability.
Sale items are not eligible for change-of-mind returns or exchanges.
This does not affect any rights a customer may have under the Australian Consumer Law.
14. FAULTY, DAMAGED OR INCORRECT CLOTHING
If a product is faulty, defective, damaged or incorrectly supplied, customers should contact info@itghoops.com with their order number and details of the issue.
Photographs or other information may be requested to help assess the issue.
ITG will assess the issue and provide an appropriate remedy in accordance with applicable consumer law.
Where required by law, ITG will cover reasonable return costs associated with a faulty, defective or incorrectly supplied product.
15. AUSTRALIAN CONSUMER LAW
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law or other applicable legislation.
Where a product has a major failure, you may be entitled to a refund or replacement and compensation for reasonably foreseeable loss or damage.
Where a product has a minor failure, you may be entitled to have the product repaired or replaced.
Consumer guarantees and other legal rights apply regardless of whether a product is purchased at full price or on sale.
16. DISCOUNTS & PROMOTIONAL CODES
Promotional codes and discounts may be subject to individual terms and conditions.
Unless otherwise stated:
Promotional codes cannot be exchanged for cash.
Promotional codes cannot be applied retrospectively to previous purchases.
Promotional codes may have expiry dates.
Promotional codes may have usage or customer restrictions.
Only one promotional code may be used per order.
Specific promotional terms displayed with a promotion will apply where they differ from these general terms.
17. INTELLECTUAL PROPERTY
All ITG and ITG Hoops branding, logos, graphics, photographs, videos, designs, text and other original content are owned by or licensed to ITG unless otherwise stated.
You may not reproduce, distribute, modify, sell or commercially exploit ITG intellectual property without written permission.
18. WEBSITE USE
You agree not to:
Use the website for unlawful purposes.
Attempt to gain unauthorised access to the website or its systems.
Interfere with the operation or security of the website.
Copy or reproduce website content without permission.
Use the website to distribute malicious or harmful material.
ITG reserves the right to restrict or terminate access to the website where reasonably necessary.
19. WEBSITE INFORMATION
ITG makes reasonable efforts to ensure that information on the website is accurate and up to date.
However, we do not guarantee that all information will always be complete, accurate or error-free.
ITG may update products, prices, services, availability and website content from time to time.
20. PRIVACY
Personal information collected through the ITG website is handled in accordance with our Privacy Policy.
By using the website or purchasing from ITG, you acknowledge that your information may be collected and processed as described in our Privacy Policy.
21. CHANGES TO THESE TERMS
ITG may update these Terms & Conditions from time to time.
The version published on the website at the time of a purchase or booking will generally apply to that transaction, subject to any rights that cannot legally be excluded.
22. GOVERNING LAW
These Terms & Conditions are governed by the laws of Queensland, Australia, except where another law is required to apply.

PARENT / GUARDIAN CONSENT
For participants under 18 years of age, a parent or legal guardian must provide consent before participation in ITG Hoops training where required.

I authorise ITG Hoops staff to seek appropriate emergency medical assistance for the participant if reasonably necessary and I cannot be reached.
I have provided accurate emergency contact information.
I understand the ITG Hoops cancellation, booking and payment conditions.
I understand the ITG Hoops media consent provisions where media consent has been provided.
